  • FAQ-19:
    My Project received an award in a previous solicitation. However, the Project did not proceed to contract. Am I able to re-submit my project during the current solicitation at a higher price?

    If a Project wins an award in a solicitation and does not proceed to contract:

    • a Pricing Proposal for the same Project may be re-submitted at the same or at a lower price in a subsequent solicitation; and
    • a Pricing Proposal for the same Project may be re-submitted at a higher price, but only if both of the following conditions are met: (a) In the solicitation in which it first received an award, the Owner of the Project provided the cash deposit for the Project within the timeframe required; and (b) the time between the submission of a Pricing Proposal that resulted in an award and the submission of a subsequent Pricing Proposal is no less than six (6) months.

    A Project is the “same” Project as a Project that previously received an award if the Projects are in the same location and have the same NJCEP Application Number.

    What did the April 28, 2010 Board Order approving the results of the March 2010 Solicitation determine regarding the re-submission of projects that had previously received an award?

    The April 28, 2010 Board Order approving the results of the third Solicitation can be found on the Documents page of the web site.

    The Board found that two projects should not receive an award in the March Solicitation due to non-compliance with the RFP Rules. The Board noted that:

    • The bidder failed to sign the SREC PSA within 5 days of the EDC's notice;
    • The bidder resubmitted the same projects at a higher bid price, in breach of the requirement to keep bid prices open for a period of 120 days before submitting an additional price offer.

    The Board rejected the two projects and provided the choice for the bidder to sign the SREC PSA with the price terms awarded by the Board for those projects in the December solicitation or to re-submit the two projects in a future solicitation round.

    The Board also ordered that an additional provision be included in the RFP to specify the circumstances under which a project that receives an award may participate in a future solicitation at a higher price. In compliance with the Order, the RFP now includes provisions specifically addressing the circumstance of a project that wins an award in a solicitation, does not proceed to contract, and is resubmitted in a subsequent solicitation. In that case:

    • a Pricing Proposal for the same Project may be re-submitted at the same or at a lower price; and
    • a Pricing Proposal for the same Project may be re-submitted at a higher price, but only if both of the following conditions are met: (a) In the solicitation in which it first received an award, the Owner of the Project provided the cash deposit for the Project within the time frame required; and (b) the time between the submission of a Pricing Proposal that resulted in an award and the submission of a subsequent Pricing Proposal is no less than six (6) months.

    A Project is the "same" Project as a Project that previously received an award if the Projects are in the same location and have the same NJCEP Application Number.

  • FAQ-17:
    The sample Bid Form references our acceptance of the RFP terms. Does the “RFP” refer to the RFP Rules or to some other, separate, document?

    Please see Paragraph 1.5.1 of the RFP Rules. The RFP refers to the RFP Rules and its appendices, including the SREC Purchase and Sale Agreement ("SREC PSA"). There is no separate RFP Document.

  • FAQ-16:
    I submitted multiple Expression of Interest Forms, and received a separate Bid Form for each Project. How do I submit my Pricing Proposals?

    If you are submitting Pricing Proposals for multiple projects, you will receive a separate Bid Form for each Project, and you will be required to submit a completed Bid Form for each Project using the secure electronic file transfer system. If you provided the same email address in the Expression of Interest Forms for multiple Projects, the password to log into the file transfer system will be the same for all Projects associated with the same email address. Once logged into the file transfer system, you may transfer Bid Forms for multiple Projects at once, by simply repeating the procedure described in the instructions provided to you with your Bid Form. Please note that you must also submit a complete qualification package for each Project as well.

  • FAQ-15:
    I intend to submit bids for multiple Projects. Do I need to submit an Expression of Interest Form (“EOI”) for each Project?

    Yes, each Project will have a unique NJCEP Application Number, and you must submit an EOI for each one.

    The Solicitation Manager confirms receipt of Expressions of Interest by email.

  • FAQ-13:
    The Appendix C (Host's Acknowledgement and Certification) reads "The undersigned is the owner of the Facility at which ____, the Seller named in the Solar Renewable Energy Certificate Purchase and Sale Agreement dated ____, 20__ with..." This form needs to be signed by the Host and submitted as part of the qualification materials. Can I confirm with you that I do not need to complete the date because the SREC Purchase and Sale Agreement (“SREC PSA”) will not have been signed when we submit the document?

    Yes, that is correct. Please submit Appendix C, leaving blank the dated portion of the following section: "... named in the Solar Renewable Energy Certificate Purchase and Sale Agreement dated ____, 20__ with...".

    The SREC PSA will be signed after the Seller is notified that the Board has approved the Seller's Pricing Proposal. According to Section 4.1.7. of the RFP Rules, "... if the Proponent becomes a Successful Proponent, the Owner of the Project will sign the SREC PSA within five (5) business days of being given a Final Notice of Award by the EDC (The EDC will give such notice no earlier than forty-five (45) days after the date of service of the Board Order, as further explained in Article 5)." The date can be filled when the SREC PSA is executed.

    Why is there such a long gap expected in the schedule between the announcement of the results and execution of the SREC Purchase and Sale Agreement (“SREC PSA”)?

    Once there has been an award, it is subject to appeal by parties in the proceeding. The gap is to ensure that the contract pursuant to the award is only signed once the Order from the BPU is final and no longer subject to appeal.

    Are any of the contract terms negotiable?

    No. The contract is approved by the New Jersey Board of Public Utilities and is not negotiable. All bidders would be signing the same contract. This SREC Purchase and Sale Agreement is posted to the Documents page of the web site.

  • FAQ-10:
    If a Project receives an award under your Program and an SREC Purchase and Sale Agreement is executed, can the applicant then transfer that award to a Power Purchase Agreement (“PPA”) provider, assuming the project will continue to be performed at the applicant's site?

    The SREC Purchase and Sale Agreement (“SREC PSA”) must be executed by the owner of the Project. The owner of the Project is directly responsible for all obligations under the terms of the SREC PSA and the owner of the Project will receive all payments under the SREC PSA. Please see Section I of the Terms and Conditions for the terms under which the SREC PSA may be assigned or transferred. Such assignment or transfer generally requires the prior written consent of the EDC. Such consent will not be unreasonably withheld.
