  • FAQ-139:
A portion of our Project received acceptance for a CORE rebate. If we elect not to accept the CORE rebate, can we submit a Proposal for that Project under the SREC-Based Financing Program?

Yes. Paragraph 1.2.12 of the RFP Rules states that Projects that received or will receive a rebate from the Customer On-Site Renewable Energy ("CORE") Program in force from 2001 to 2008 are not eligible to present a Proposal under the SREC-Based Financing Program ("Program"). If you have not yet received the rebate, and you elect not to receive the CORE rebate in the future, then your Project would be eligible to participate in the Program.

  • FAQ-138:
Are there any exceptions to the rule that prohibits projects that received or will receive rebates from the CORE Program from participating in the SREC-Based Financing Program?

No. Paragraph 1.2.12 of the RFP Rules state that Projects that received or will receive a rebate from the Customer On-Site Renewable Energy ("CORE") Program in force from 2001 to 2008 are not eligible to present a Proposal under the SREC-Based Financing Program ("Program"). There are no exceptions as this is a condition of the SREC Purchase and Sale Agreement that Owners of Successful Projects must use when they receive an award under the Program. Please note that if the Owner of the Project had not yet received the rebate and elected not to receive the CORE rebate in the future, then the Project would be eligible to submit a Proposal under the Program.

  • FAQ-137:
Can I change the size of the project that has received an award under the SREC Based Financing Program?

Generally the specifications of a Successful Project may not be changed after receiving an award from the Board. A given SREC PSA is specifically tied to a particular Project, which will be described in Appendix B of the SREC PSA, found on the Documents page of the web site.  Appendix B will identify all of the main characteristics of the Project. However, the Program recognizes that the constructed size of a Project may differ from the size of the Project as planned and as presented in the Proposal. If this were to occur, the Owner may request that the EDC approve a modification in the size of up to 10%. The EDC will approve such a modification provided that the Project continues to satisfy all other requirements related to this Program and that this modification: (a) does not change the segment to which the Project belongs; (b) does not cause the Developer Cap to be exceeded; and (c) does not cause the Project to exceed 2 MW.

  • FAQ-136:
When will the Board consider the awards for Round 6?

For this Round 6 solicitation, it is expected that the Board will consider the results at its agenda meeting of March 30, 2011. This date is tentative as it depends on various factors including the availability of the Parties to consider the Preliminary Recommendations of the Solicitation Manager and changes to the Board's scheduled meetings (http://www.nj.gov/bpu/agenda/schedule/2011schedule.html).

The Solicitation Manager will provide updates on the schedule as they become available, either through an announcement or through changes to our Calendar page. We invite you to contact us after March 1, 2011 at which point an update on the schedule for this solicitation is expected to be available.

  • FAQ-135:
According to Section 4.1.4. of the RFP Rules, Proponent must not “request interconnection prior to the Board Order on the results of this solicitation”. Please clarify if this date refers to the date when the Board Order is issued or if this date refers to when the Board Order is no longer subject to appeal (i.e., 45 days later) and is final.

A Proponent may request interconnection after the Board Order on the results of the solicitation is issued. The Board Order is issued typically within a few days of the Board renders a decision on the results of the RFP. The Calendar page of the RFP Web site provides the date at which Board is expected to render its decision. The Proponent is not required to wait until the Board Order becomes final.

  • FAQ-130:
Section F of the SREC PSA provides for the EDC to make additional requests for information if it chooses to do so. If additional requests are made by the EDC, and those requests prevent us from living up to our obligations under the contract, will we forfeit the deposit?

If the Owner of the Project fails to satisfy its obligations under the SREC PSA, the EDC may retain the Deposit. Further, if the Project is not completed within one year of execution of the SREC PSA, the EDC may terminate the SREC PSA upon notice to the Owner of the Project. The EDC will take into consideration any demand for additional information, instruments, documents or actions made of the Owner of the Project and that the EDC believed were necessary to give full effect to this Agreement in deciding whether to exercise its rights to retain the deposit or to terminate the SREC PSA.
