  • FAQ-179:
    Regarding FAQ-164, is there a specific form of assignment required, or would something along the lines of the following be sufficient to assign the proceeds? For good and valuable consideration, receipt of which is acknowledged, I (we) hereby assign, transfer and deliver to _________ (the “Assignee”), all rights of payment that I (we) have under the Solar Renewable Energy Certificate Purchase and Sale Agreement with [Jersey Central Power & Light Company]. Date of Agreement: Annual SREC Generation Capacity: IN WITNESS WHEREOF, the parties have executed this Agreement: [signatures of assignor and assignee]

    As noted in FAQ-164, the assignment of benefits under the SREC Purchase and Sale Agreement (“SREC PSA”) would occur after the Board has made the award to the Project, after the Board Order is no longer subject to appeal, and after the SREC PSA has been executed (in the mid-May 2011 timeframe for the current solicitation). We will transmit your proposed assignment language to the EDCs for their review. We will update this response as soon as we have additional information.

  • FAQ-178:
    I have recently submitted my applications to the SRP but have not received my NJCEP Application number. When is the deadline to complete the Expression of Interest with a valid NJCEP Application Number in time for this February 2011 solicitation of the SREC Based Financing Program?

    For the Expression of Interest to be complete and compliant with the terms of the RFP, it must include your NJCEP Application Number. If you submit your Expression of Interest without a NJCEP Application Number, your Expression of Interest will be incomplete, and the Solicitation Manager will send you a deficiency notice. You will be given until 5:00 PM (eastern prevailing time) on the deadline to cure EOI deficiencies to provide the NJCEP Application Number, as well as any other missing or incomplete information. The deadline to cure EOI deficiencies is Wednesday, February 16, 2011. The Office of Clean Energy processes materials for the SREC Registration Program (“SRP”). The Office of Clean Energy considers, when processing materials, whether the application includes an ESFI notice of intent to participate (for residential projects up to 10 kW or non-profit/public projects up to 50 kW) or a cover letter (for other projects) indicating your intention to participate in the SREC-Based Financing Program. If you did not include information for the Office of Clean Energy that you intend to participate in the SREC-Based Financing Program, Please consider advising them of this fact.  They may be contacted at 1-866-NJSMART or NJREinfo@csgrp.com

  • FAQ-177:
    Are all bidders in the SREC based Financing Program required to complete the ESFI “Intent to Participate” form under the SRP prior to participation in your SREC Based Financing Program?

    Our understanding is that the ESFI “Intent to Participate” is a form that participants with residential projects up to 10 kW or participants with public or non-profit projects up to 50 kW should complete to indicate their intention to participate in the SREC-Based Financing Program. Other projects that intend to participate in the SREC-Based Financing Program can indicate their intention to participate with a cover letter. Please note that Expressions of Interest for the current solicitation in the SREC-Based Financing Program were due February 11, 2011 and that the Office of Clean Energy was expected to require a complete application by February 4, 2011. We are the managers for the SREC-Based Financing Program; the Office of Clean Energy administers the SREC Registration Program (“SRP”) and EDC Solar Financing Incentive (“ESFI”). For further information please contact their program managers directly:

  • FAQ-176:
    In your announcement dated February 4, 2011, you stated “Please note that currently only applications under the SRP are considered”. Does this mean REIPR approved customers are not eligible to participate in the SREC Based Financing Program?

    To participate in the SREC-Based Financing Program (the “Program” or the “auction”), a Project must have successfully completed the Initial Application process under the Renewable Energy Incentive Program (“REIP”) or the SREC Registration Program (“SRP”) administered by the New Jersey Clean Energy Program (“NJCEP”).   Projects approved under the REIP are eligible for the Program. The sentence “Please note that currently only applications under the SRP are considered” refers to our understanding that, starting January 2011, new applications to the NJCEP are made only under the SRP (and not the REIP). We are the Solicitation Manager for the Program; the NJCEP administers the REIP and SRP. For further information about the NJCEP Initial Application Process, including whether Projects that were approved under the REIP are eligible for the $0.50 incentive, please contact:

  • FAQ-175:
    We have been told we cannot produce more power with solar panels than what we used in the past 12 months. Is this true?

    When you say that you were “told that you cannot product more power than we used in the past 12 months” we assume that you are referring to requirements of the SREC Registration Program (“SRP”). To participate in the SREC-Based Financing Program (the “Program” for which we are the Solicitation Manager), a Project must have successfully completed the Initial Application process under the Renewable Energy Incentive Program (“REIP”) or the SREC Registration Program (“SRP”) administered by the New Jersey Clean Energy Program (“NJCEP”).   We do not administer the SRP and we can only refer you to the managers of that Program for further information:

  • FAQ-174:
    Did the Solicitation Manager ever post the document for lessors described in FAQ #30? I have not been able to find it. Also, must a Developer "own" a Project in order to be a Proponent, or is it sufficient that the Customer agrees to assign his SRECs to the Developer and signs both the PJM-EIS-GATS Schedule A and the SREC PSA Appendix C?

    Many commercial arrangements can be accommodated within the Program, including the ownership of the premises, the ownership of the Project, and the benefit of the electricity generated by the Project all belonging to different parties. However, the assignment of SRECs to a party other than the Owner of the Project is not contemplated by the standard contract (the SREC Purchase and Sale Agreement or SREC PSA), which must be used for all awards under the Program. Under the SREC PSA, the party that owns the Project and the party that receives the SRECs and sells the SRECs to the EDC is one and the same.

    The commercial arrangement contemplated by FAQ #30 was a situation where the Customer was the owner of the SRECs and the eventual owner of the Project. The document referenced by FAQ #30 is available from the Solicitation Manager upon request by Proponents whose commercial arrangements are as described in FAQ #30. Please note that the document in question is not intended for other commercial arrangements or for use generally to effect the assignment of SRECs prior to submission of the Proposal. 

    We note also that once the Owner of a successful Project has signed the SREC PSA with the EDC (assuming the project is successful), the Owner may assign the benefits of the SRECs (i.e., the revenue from the SRECs received under the SREC PSA) to another party through its own arrangements as long as such an assignment complies with Section I of the SREC PSA.

  • FAQ-173:
    In the event there is a lot of rainy and cloudy days during the term of the SREC PSA, will the amount of revenue from the SREC PSA decrease?

    An SREC is produced for each MWh of output of the Project. As you note, the output of the Project will be variable. The SREC PSA provides a payment for each SREC produced by the Project and does not in any way guarantee payment if the Project does not produce SRECs regardless of the reason.

  • FAQ-172:
    For Rounds 1 through 4, there appears to be discrepancies between solicitation results found in the applicable Board Orders approving the results of the solicitations and the information you provide in the summary file for the results by segment (http://www.njedcsolar.com/assets/files/NJEDCSolar_Results_by_Segment_10-8-2010.pdf). For example, the December 2009 solicitation has approximately 6.6 MW awarded according to the Board Order and the summary file lists approximately 5.5 MW awarded.

    Regarding the file that provides results by segment, explanatory notes were inadvertently excluded from this file. We will modify the file to provide these additional notes shortly. These additional notes should read as follows:

    • The amounts provided for the August 2009 and December 2009 solicitations exclude awards that did not proceed to contract;
    • The amounts provided for the March 2010 solicitation may include awards that did not proceed to contract;
    • For the June 2010 solicitation, contract execution was in progress at the time the data was compiled.

  • FAQ-171:
    Can you please provide the breakdown of the solicitation results between ACE, JCP&L and RECO for Round 5?

    There is no provision for release of information specific to an EDC. However, the Solicitation Manager does provide the quantities planned for the 2011 RPS Reporting Year (see Table 1 of the RFP Rules) as well as the quantities planned for this upcoming solicitation (see Table 2 of the RFP Rules). The quantities planned for this upcoming solicitation (round 6) represent the unfilled quantities from the first two solicitations for 2011 RPS Reporting Year (rounds 4 and 5). Thus, the quantities that were filled in rounds 4 and 5 are the difference between the quantities planned for the 2011 RPS Reporting Year (in Table 1) and the quantities planned for this upcoming solicitation (in Table 2).

  • FAQ-170:
    When is the earliest date when we can request for final interconnection for the Project without violating the program rules for participation under the SREC Based Financing Program?

    The RFP Rules specify that the Project must not be interconnected and that the REQUEST for interconnection must not be made prior to the Board Order on the results of the solicitation. The Board Order is issued typically within a few days of the Board rendering a decision on the results of the RFP. The calendar on the RFP Web site provides the date at which Board is expected to render its decision. This would be the earliest date at which interconnection could be requested or filed.
